- By using the Mokuen Studio official website, you confirm that you have read, understood, and agree to comply with the following Terms of Use and Privacy Policy. These documents constitute the entire agreement between both parties regarding the use of this website -
1. Applicability
1. The following Terms of Use(hereinafter, "Terms of Use") apply to all matters related to customers’ use of the product catalog, online shopping, and other services (hereinafter, “the Services”) operated and provided by Mokuen Studio Company Limited (hereinafter, “Mokuen Studio”).
2. These Terms apply to all customers (hereinafter, “Customers”) who use the Services, as well as to any matters arising between such Customers and Mokuen Studio.
2. Use of Services
1. Customers must agree to these Terms of Use and use the Services and browse the Mokuen Studio official website related to the Services in accordance with these Terms and other provisions established by Mokuen Studio. Once a customer uses the Services, it is deemed that they have agreed to all terms and provisions.
2. Customers are fully responsible for all data transmitted through the Services or Mokuen Studio’s official website and shall ensure not to cause any damage or inconvenience to Mokuen Studio.
3. If the customer is a minor, they must obtain consent from a parent or legal guardian before using the Services.
4. Mokuen Studio does not guarantee that the content provided through the Services will be compatible with all customers’ computer environments at any time, nor that the official website or the Services will always function properly.
5. Whether or not to log in to the Mokuen Studio official website is a personal choice of the customer; therefore, the customer shall bear all responsibilities for the use of the website and the Services.
3. Suspension of Service to Individual Customers
If a customer commits any of the following or is deemed by Mokuen Studio to be unsuitable for the Services, Mokuen Studio has the right to suspend the Services to that customer without prior notice:
1. Engaging in any prohibited acts listed in Section 4; or
2. Violating any other terms in these Terms of Use.
4. Prohibited Matters
While using the Services, Customer must refrain from engaging in the following acts; if Customer's act falls under any of the following, Mokuen Studio may, among other things, stop providing the Services to or doing transactions with the Customer.
1. Using the Services or any information (including product information), provided on Mokuen Studio offical website for purposes of making a profit;
2. Any act which disturbs the management of the Services;
3. Abusing a credit card through use of the Services;
4. Abusing the email address or password;
5. Any act which violates the trademark, copyright, trade secret or any other rights of Mokuen Studio Company Limited, or any act which could cause annoyance, loss or damages to Mokuen Studio Company Limited;
6. Any act which may constitute a libel, slander or defamation against Mokuen Studio Company Limited;
7. Any act that is a violation of law; or any act which could be a violation of law;
8. Falsifying information regarding Mokuen Studio or the Services or information provided through the Services; or
9. Sending or posting harmful computer programs, viruses, malware, spyware, or anything related to the preceding.
5. Intellectual Property Rights
The content, images, designs, and related trademark rights, copyrights, and other intellectual property rights displayed on the Mokuen Studio official website are owned by Mokuen Studio Company Limited and/or individual licensors, and customers must not infringe upon these rights.
6. Payment
1. Customers must read, understand, and agree to the online payment terms and conditions designated by Mokuen Studio.
2. When paying by credit card, customers must comply with the terms and conditions between themselves and the credit card company. Any disputes between the customer and the credit card company must be resolved between those parties, and Mokuen Studio will not bear any responsibility.

8. Interruption of Services
Mokuen Studio may amend, add, stop or cancel the Services without prior notice to Customer and without the Customer’s consent in the following cases. Mokuen Studio is not responsible for any damage caused to the Customer by the amendment, addition, stoppage or cancellation of the Services.
1. In cases where periodic or urgent maintenance on the system is necessary;
2. If it is impossible to provide the Services due to force majeure clauses (natural disaster, war, riot, rebellion, terrorism, fire, explosion, flood, burglary, harm, striking, immigration restrictions, weather, hindrance from third party, national defense, public health related emergency, regulation or policy of the local public body or government and any other events etc., which beyond the control of Mokuen Studio); or
3. Any other situation where Mokuen Studio considers necessary.
9. Exemption Clause
1. If Mokuen Studio conducts administrative work in accordance with the contents of the Customer’s registration, Mokuen Studio is not responsible for any damage caused to the Customer due to its administration.
2. Mokuen Studio shall not be responsible to the Customer for any damage or lost earnings caused by:
- (a) events that are not Mokuen Studio’s responsibility;
- (b) special circumstances with or without Mokuen Studio foreseeing such a circumstance;
- (c) Customer’s illegal acts; or
- (d) any third party's damage claim.
3. If there is a dispute regarding use of the Services between Customer and any third party, the dispute must be settled by the relevant parties only and must not cause any damage or annoyance to Mokuen Studio.
4. The information and materials contained in this site, including text, photographs, links or other items are provided "as is", "as available". Mokuen Studio does not warrant the accuracy, adequacy or completeness of this information and materials and expressly disclaims liability for errors or omissions in this information and materials. No warranty of any kind, implied, expressed or statutory including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given in conjunction with the information and materials.
5. In no event will Secret Base be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this site or any linked site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure.
10. Amendment
1. Mokuen Studio may amend charges of the Services, content of the Services, and other Terms of Use (hereinafter, "Content of these Terms") according to social situation, economic circumstances, change in tax system and other various circumstances, change in law and other changes that are related to the Services.
2. In the event that Mokuen Studio makes changes to the Contents of these Terms based on the term of the preceding paragraph, Mokuen Studio shall display the changed Contents of these Terms on Mokuen Studio official website or notify the Customers in any manner Mokuen Studio considers proper. And the modified Terms shall apply from the date on which a considerable period of time has passed after the notification.
3. If Customer does not agree the amended terms, he/she shall stop using the Services. Customer who continues to use the Services shall be regarded as having agreed to the amendment.
11. Governing Law
The construction and application of these Terms of Use shall be governed by laws of Hong Kong Special Administrative Region.
*In the event of any dispute or amendment regarding the above terms and conditions, Mokuen Studio Company Limited reserves the right to make the final decision.
*If there is any inconsistency or ambiguity between the English version and the Chinese version, the Chinese version shall prevail.
